New York Residents may pick up at our office during scheduled removal times and must complete a Form 4473 and Pass a NIC's Background Check.  Must bring proper valid ID.  Driver's License, Passport or Military ID.  Failure to pass a NIC's Background Check does not constitute the opportunity to obtain a refund as all sales are final and absolute. By bidding and purchasing any item, you hereby certify that:
1) You have no felony convictions and are in full compliance with Local, State and U.S. Code, allowing for the lawful purchase of ammunition, firearms and or any accessories, including ballistic vests.
2) You are at least 21 years of age, live in a state where this purchase is not prohibited, you are not under indictment for, and have not been convicted in any court of a crime punishable by imprisonment for a term exceeding 1 year, you are not a fugitive from justice, are not an unlawful user of or addicted to any controlled substance, have not been adjudicated as a mental defective nor have you been committed to any mental institution, and you are not an alien illegally or unlawfully in the United States.
3)Buyer assumes all liability for any purchase and agrees to not misuse it in any manner.

Any purchase against these terms and conditions will result in all liability to fall upon the purchaser and by bidding and or purchasing, you unconditionally acknowledge and agree to be fully bound.

For safety reasons, we do not accept returns. Also, always make sure you use the correct ammunition for your specific firearm.

Pictures may be stock photos to aid in identification and may not be the actual items purchased or shipped.

SHIPPING: All Shipping and packaging of items other than firearms and ammunition, shall be provided (INDEPENDENTLY) by The UPS Store, locally owned and operated by Chuck & Joan Alley at an additional cost TO PURCHASER. All items will be shipped with insurance at buyers expense. You must call 518-843-0550 to arrange shipping of your items once full payment has been received by the Auction Company. Local purchasers may pick purchases up as noted in Lot Description.

A Buyers Premium Scale PER ITEM will be assessed based on the following, which will be added to the high bid price. (This is in addition to your bid price).NOTE: ALTHOUGH BUYERS PREMIUM IS LISTED AT 22%, OUR STANDARD 4% BUYERS PREMIUM DISCOUNT IS STILL AVAILABLE FOR ONSITE CASH PAYMENTS AS IT HAS BEEN FOR MANY YEARS. JUST THE CONFIGURATION OF HOW IT IS CHARGED HAS BEEN REVISED.

$0 - $50,000 = 22% BP
$50,001-$75,000 = 21% BP
$75,001-$99,999 = 20% BP
$100,000 and Up = 19% BP

No Bid may be withdrawn for any reason once placed. 

Payment Terms:Full Payment is due within (3) days after auction closes. Payment must be made through your member area if paying via credit or debit card (NO AMEX) and payments via CASH ONLY may be made at the Auction Site and/or our office during scheduled removal period. Deviation from these Payment Terms may cause your account to be suspended and the item may be awarded to the backup-bidder, or re-listed. We will, however, be happy to revise your invoice after the deadline for a $75.00 fee and will make revision once the revision fee has been received in full.

Auction Company and Seller are NOT responsible for providing tools, labor or heavy equipment to assist in removal or loading. Items left on premises after removal deadline will revert to possession of the Auction Company or Seller without refund.

Conduct of Strictly Online Auction: We use dynamic ending times for all on-line auctions. On-line auction ending times vary and will be extended by two-minute intervals if bids are placed during the last minute of the scheduled auction ending time. Such extension of the ending time of the auction will continue, in two-minute intervals, as long as active bidding continues. Once there are 120 seconds without any bidding, no further extensions will be given and the auction will end. ALL BIDS DO NOT CLOSE OUT AT ONE TIME, BUT IN GROUPS BEGINNING AT THE SCHEDULED CLOSING TIME LISTED FOR EACH LOT INDIVIDUALLY. This does not apply to Live Simulcast Auctions.
